Hearing of Mukesh's conviction in HC, demand for cancellation of death warrant


Mukesh has said that his mercy petition is still pending with the President, so the death warrant should be canceled.  Senior advocate Rebekah John is fighting the case on behalf of Mukesh.

Curative petition has been rejected from SC

 High court said - why wait for two and a half years

 The hearing has started in the Delhi High Court on the application of Nirbhaya gang rape accused Mukesh Kumar.  The guilty Mukesh has demanded a stay on the death warrant.  Mukesh has said that his mercy petition is still pending with the President, so the death warrant should be canceled.

 Senior advocate Rebekah John is fighting the case on behalf of Mukesh.  On Tuesday, a five-judge bench of the Supreme Court dismissed Mukesh's curative petition.  On 18 December, Tihar Jail Authority has issued notice to all the culprits.  It was said in the notice that you can file a mercy petition within 7 days if you want.  During the video conferencing, it was said on behalf of the two convicts that their case has not received the correct plea, so it should also be considered.

 Mukesh's lawyer Rebekah John said that the order passed by the trial court on January 7 has not yet been served.  If we had given 7 days notice to file mercy petition on the order of 18 December, it would have ended on 25 December.  But Amicus was given permission to meet the convict on the 30th and the convict immediately stated that he intended to file a curator.

 A curative petition was filed within 2 days after receiving the documents from the Supreme Court registry.  After the curative petition was rejected, we did not wait even a day to file a mercy petition.  I am asking the President to consider the application.  The mercy petition is the constitutional duty of the President and is not an act of grace.

On this, the High Court said, your appeal was dismissed in April 2017.  Even then you waited for two and a half years.  Did not even file a review petition, no curative was even filed.  What stopped you from filing this?  The court said that why would anyone wait till the death warrant is issued to file a mercy petition.  The guilty has been given full time to go to court.
